Insurance for Mine and Plant Contractors in Rajasthan
A contractor working at a large mine, smelter or cement plant is asked for insurance before the first worker is allowed through the gate. The list looks like paperwork, but each item answers a real liability, and the most important of them, workmen compensation, exists because the law can make the principal pay for the contractor's injured worker.
Or request a callback. Free, no obligation, and we answer at any hour.
What to know
- Section 81 of the Code on Social Security, 2020 makes a principal employer liable to pay compensation to a contractor's employee injured on its work, and lets the principal recover it from the contractor. That is why principals require a contractor's own workmen compensation policy.
- The policy must match the deployment: the site, the number of workers, their wages and the work they do. Declaring fewer workers or lower wages than are actually deployed gives an insurer grounds to contest a claim.
- Excavators, loaders, drills and cranes need contractor's plant and machinery cover; a fire policy does not follow mobile plant around a pit.
- Erection or installation work inside a plant is a project risk for erection all risk cover, and the principal will usually want third-party liability cover as well.
Why the principal asks for workmen compensation cover
Under section 81 of the Code on Social Security, 2020, where a principal has work that is part of its own business done through a contractor, the principal can be made to pay compensation to the contractor's employee injured on that work, as if it had employed the worker itself. The principal is then entitled to be indemnified by the contractor, and the worker can also claim from the contractor directly.
So a mine or plant that lets an uninsured contractor's crew onto site is carrying that crew's injury liability itself. The vendor requirement for a contractor's workmen compensation policy, valid for the contract period and covering the workers deployed, is how the principal passes that liability back to where the law says it belongs.
Getting the policy to match the site
Workmen compensation premium is set on the wage roll and the nature of the work, and the policy covers the workers it describes. A policy taken for twenty workers on light duties does not sit well with eighty workers at a working face, and that mismatch is the first thing examined after a serious accident.
Name the site, declare the real headcount and wages, and keep the declaration current when the deployment grows. Ask whether the principal wants to be named on the policy, which many vendor processes require, and whether the contract asks the insurer to waive any right to recover from the principal.
Workers covered by ESI receive their employment injury benefits through ESIC. Workers outside it, because of the wage ceiling or the area, need the contractor's own policy, and many crews include both.
Plant, vehicles and the work itself
Mobile plant working across a pit or a plant yard needs contractor's plant and machinery cover, which follows the machine rather than a fixed address. Tippers and dumpers that also use public roads need motor cover; vehicles working only inside the lease should be checked against what the motor policy and the plant policy each say.
Where the contract is to erect, install or commission equipment, the works themselves are a project risk. Erection all risk cover protects the works during the job and is often required by the principal, with the principal named as an insured party.
Third parties, and the people the law does not oblige you to cover
A contractor's crew can injure the principal's own staff or damage its property. A public liability policy, with a limit the principal will accept, is what responds, and most vendor lists ask for one.
Group personal accident cover pays a fixed benefit to a worker or their family regardless of fault or of what the statute requires. It sits alongside workmen compensation, not in place of it, and is often what a contractor actually wants to be able to offer a family after an accident.
Frequently asked questions
Why does the principal employer ask for my workmen compensation policy?
Because under section 81 of the Code on Social Security, 2020 the principal can be made to pay compensation to a contractor's injured employee and recover it from the contractor. Your policy is how that liability is funded.
Is workmen compensation insurance compulsory for contractors?
The law makes the employer liable to pay compensation, insured or not; the policy is how that liability is paid for. Large mines and plants make the policy a condition of working on site.
Do I still need workmen compensation cover if my workers are under ESI?
Workers covered by ESI receive employment injury benefits through ESIC. Workers outside ESI, by wage or area, still need your own policy, and many crews include both kinds.
Are my excavators covered by my motor or fire policy?
Usually not fully. Mobile plant working on site needs contractor's plant and machinery cover. Vehicles that also run on public roads need motor cover, and the two should be checked together so nothing falls between them.
Do you have an office near the mines?
Our office is in Udaipur, at 784 Rani Road, which sits within the mining belt of southern Rajasthan. We advise contractors across Rajasthan from there and visit sites for inspections and claims.
