Frequently asked questions

Is workmen compensation insurance mandatory in India?

The liability is mandatory and cannot be contracted out of. It sits in the Code on Social Security, 2020, which absorbed the Employees' Compensation Act 1923 on 21 November 2025. The insurance policy covering it is not itself compulsory under the Code, though many state rules, tender conditions and client contracts require it. Carrying the liability uninsured is legal and rarely sensible.

Am I liable for my contractor's workers?

Usually yes. Section 12 makes the principal employer liable for compensation to a contractor's workers engaged on work forming part of your trade, with a right to be indemnified by the contractor. In practice the claim reaches you first, so ask contractors for their certificate before work starts.

How is the compensation amount calculated?

Death compensation is fifty per cent of monthly wages, capped at ₹15,000 for the computation, multiplied by the Schedule IV age factor, subject to a minimum of ₹1,20,000. Permanent total disablement is sixty per cent on the same basis, with a minimum of ₹1,40,000. The Commissioner sets the final award.

What if the worker was careless?

Compensation is still payable. Liability is strict and contributory negligence is not a defence. The narrow exceptions for intoxication and wilful breach of safety rules do not apply where the outcome was death or permanent total disablement.
